THE HUGH HOWEY BOOKTRACK COMPETITION RULES

NO PURCHASE OR PAYMENT NEEDED TO ENTER OR WIN. THE COMPETITION IS OPEN ONLY TO ELIGIBLE BOOKTRACK USERS (WHERE ALLOWED BY LAW) WHO ARE AT OR OVER THE AGE OF 13 AS OF THE DATE OF SUBMISSION. 

BY ENTERING AND PARTICIPATING IN THIS COMPETITION, YOU REPRESENT THAT YOU SATISFY ALL ELIGIBILITY REQUIREMENTS BELOW AND YOU HAVE READ AND AGREE TO BE BOUND UNCONDITIONALLY BY THESE RULES. 

THIS COMPETITION IS VOID WHERE PROHIBITED BY LAW.

This Competition is sponsored by Booktrack (the “Sponsor”) and is open to any Entrant (as defined below) who has entered a Submission.  Any violation of these Rules may, at the Sponsor’s discretion, result in disqualification. All decisions of the Sponsor regarding this Competition are final and binding in all respects. 

This Competition is comprised of two Contests, the Hugh Howey Booktrack and Wattpad Fan Fiction contest (“Fan Fiction Contest”) and the Hugh Howey Booktrack and Indaba Soundtrack Contest (“Soundtrack contest”). The two Contests are collectively known as the Competition. All rules are shared except where noted.

 

1. COMPETITION PERIOD AND DATES

The Competition begins on 28th May 2014 (“Start Date”) and ends at 11:59 PM (Pacific Standard Time) on July 31, 2014 (“Final Submission Date”), when all entries must be received (the “Competition Period”).

Entries will judged and announced by August 31, 2014 (“End date”).

To enter, the user must submit their entry for one of the two Contests by tagging their story with HUGHHOWEYFANFIC (for the fan fiction contest) or HUGHHOWEYSOUNDTRACK (for the for the soundtrack contest) during the competition Period. 

All entrant information is subject to the Booktrack platform privacy policies (link). 

2. ELIGIBILITY CRITERIA.

This Competition is open to registered Booktrack users except:

  • anyone under the age of 13 at the date of entry;
  • employees, directors and immediate family members of the Sponsor, or any other partner or party associated with the Competition;
  • anyone residing in jurisdictions or countries where illegal and/or prohibited by law;
  • anyone who fails to comply with these Competition Rules or otherwise interferes with the entry or judging process.

3. HOW TO ENTER, SUBMISSIONS and DEADLINES

To submit your entry, you must publish a new Booktrack story to enter each contest.

You must code this story with HUGHHOWEYSOUNDTRACK or HUGHHOWEYFANFIC in the form provided at the time of publishing.

Entrants may submit entries in both contests.

Entrants may submit multiple entries in each contest.

Submissions must be on or before the Final Submission Date.

Entries may be revised during the competition period, but must not be altered after the Final Summission Date.

All entries must:

  • Be received during the Competition Period;
  • Be published by July 31, 2014;
  • Be written and submitted in English
  • Be appropriately rated
  • Not contain offensive material
  • Adhere to the general terms on the Booktrack platform (http://booktrack.com/terms)
  • Include an audio soundtrack using the Booktrack studio
  • Include an original cover 

Soundtrack Contest entries must:

  • Use one of the chapters from Half Way Home by Hugh Howey from the Booktrack Text Library
  • Add code: HUGHHOWEYSOUNDTRACK at point of publishing

Fan Fiction contest entries must:

  • Be fan fiction based on the characters, themes and/or locations in Half Way Home by Hugh Howey
  • Be 5000 words or less;
  • Add code: HUGHHOWEYFANFIC at point of publishing
  • Also be posted on Wattpad.com (link) in adherence to their terms (http://www.wattpad.com/terms)

  

4. WINNER SELECTION AND NOTIFICATION.

Finalist and winner selection will be conducted through a review process up to the End Date. The process and procedures of the selection process will not be disclosed.

Potential finalists and winners will be notified by email to the address provided on their accounts. If a potential finalist or winner cannot be contacted, does not respond within five (5) business days from the date the Sponsor first tries to notify him/her, refuses the Prize, or if notification is returned as undeliverable or does not return the Release form, such potential finalist or winner forfeits all rights to be a finalist or win the Competition or receive the Prize, and an alternate potential finalist or winner may be selected.

Sponsor is not responsible for any change in an Entrant's email address or for any failure whatsoever of an Entrant to receive Sponsor’s notification or for Sponsor to receive a selected Entrant’s response. Upon contacting a potential finalist or winner and determining that he/she has met all eligibility requirements of the Competition, including without limitation the execution of required waivers, publicity and liability releases and disclaimers, such individual will be declared a “winner” or a “finalist” of the Competition.

5. PRIZES.

There will be 5 finalists and 1 overall winner for each contest. Prizes may be substituted by Sponsor. Any taxes that may apply due to the winning of a prize are the sole responsibility of the prize recipient. Sponsor shall not be responsible for any failure in receipt or delivery of a prize, or for any loss of a prize after it is given or if factors beyond Sponsor’s reasonable control prevent a prize from being fulfilled/awarded.

Fan Fiction Contest:

The winner of the Fan Fiction Contest will receive

  • $5,000 USD; and
  • A video trailer of their winning work created and promoted by Booktrack
  • Editorial comment by Hugh Howey an original work of up to 10,000.

4 remaining finalists of the Fan Fiction contest will be awarded $1,000 USD.

Soundtrack Contest:

The winner of the Soundtrack Contest will receive

  • $5,000 USD; and
  • A video trailer of their winning work created and promoted by Booktrack
  • 12 months Indaba Pro membership
  • The chance* to co-produce the Booktrack for the Hugh Howey novel "Hurricane"

The 4 remaining finalists of the Soundtrack contest will be awarded

  • $1,000 USD
  • 12 months Indaba Pro membership

Winners or finalists must provide their bank account number to Booktrack to receive payment of any prize money. Payments will be made to each prize recipient’s bank account by direct credit, wire transfer or telegraphic transfer. Sponsor is not responsible for any failure in the delivery of the cash prize.

Winners and finalists will be featured on the Sponsor website and other partner websites.

Before claiming the Prize, winners and finalists must sign a Consent and Release form. Upon completion of the consent and release form, if the Prize is not claimed within 10 business days delivery, the Prize is forfeit and cannot hold the Sponsor or any partner liable for any losses relating to the Competition.

* The Soundtrack co-production prize is a best efforts offer based on future agreements to be made. If no such agreement can be made the Sponsor will make reasonable efforts to substitute the prize if possible, however the winner shall not hold the Sponsor or any partners to this competition liable for any loss relating to the original prize not being possible.

 

6. RELEASE.

Before being declared a winner or finalist, the selected Entrant will be required to sign a declaration of Consent and Release form (the “Release”) indicating that the selected Entrant:

(a) has complied and agrees to comply with these Official Rules;

(b) accepts the Prize as offered;

(c) will keep his/her winning notification confidential until notified by Sponsor;

(d) releases Sponsor, its agents, employees, partners, contractors and any other parties to be added to the Release in Sponsor’s sole discretion (the “Released Parties”) from any and all liability arising from his/her participation in the Competition or his/her acceptance, use, misuse or awarding of the Prize;

(e) indemnifies the Released Parties from any and all losses that Sponsor may incur arising out of any act or omission by him/her in connection with the Competition, Contest or the Prize; and

(f) except where prohibited by law, acknowledges Sponsor’s and its authorized representatives’ right to publish and/or broadcast the winner's name and/or statements without further compensation other than the Prize offered.

The Sponsor, in its sole discretion will determine the wording of the Release including adding additional terms it may deem to be required. The selected Entrant must return the Release by the date indicated on the document. If the Release is not returned on time or is returned as non­deliverable or is disqualified for any other reason, the Prize will be forfeited and another Entrant will be selected from the remaining eligible entries until the Prize is successfully awarded.

 

7. DISCLAIMERS.

Sponsor assumes no responsibility for and under no circumstances will Sponsor, its agents, employees, contractors, partners and assigns be liable to any person or business entity for any direct, indirect, special, incidental, consequential or other damages based on any Entrant’s participation in the Competition, including for: (i) entries which are incomplete, unintelligible, lost, late or misdirected; (ii) technical failures of any kind, including but not limited to failure of the Internet during the Competition Period, any problems, failure or technical malfunction of any network, online or electronic systems, servers, access providers, computer hardware or software, incomplete, garbled or delayed Internet/e­mail computer transmissions on account of technical problems or traffic congestion on the Internet or at any website, or any combination thereof or other failures related to hardware, software or virus; (iii) unauthorized human intervention in any part of the entry process or the Competition; (iv) technical or human error related to the administration of the Competition or the processing of entries; (v) any injury, loss or damage of any kind which may be caused, directly or indirectly, in whole or in part, from participation in the Competition by any Entrant, use or misuse of the Prize or any part thereof; (vi) any use of the Website or any other website to which the Website is linked (including without limitation any injury or damage to an Entrant’s or any other person's computer relating to or resulting from participation or downloading any materials in this Competition); or (vii) any Entrant’s failure to abide by the Official Rules. The limitations of liability set out in this Rule apply, without limitation, to any lost profits, and will apply even if Sponsor has been specifically advised of the possibility of such damages.

8. GOVERNING LAW.

By participating in this Competition, you agree to be bound by these Rules. All decisions of the Sponsor with respect to any aspect of the Competition and these Rules, including, without limitation, the eligibility of entries and the finalists and winners are final and binding on all entrants. The laws of New Zealand shall govern this Competition. All disputes arising out of or connected with this Competition will be resolved individually, and without resort to class action, exclusively by a dispute resolution service based in Auckland New Zealand with respect to any matter arising hereunder or related hereto. These Rules state all of the terms and conditions governing the Competition.

9. CHANGES AND CANCELLATIONS.

 Sponsor reserves the right without prior notice, to cancel, terminate, modify or suspend the Competition if, for any reason, the Competition is not capable of running as planned or if the administration, security, integrity, or proper conduct of the Competition is corrupted or adversely affected, including by reason of infection by computer virus, unauthorized intervention, bugs, tampering, fraud, technical failures, or any other causes beyond its control. Sponsor reserves the right to amend the Rules without prior notice if any factor interferes with the proper conduct of the Competition as contemplated by these Rules. Should multiple users of the same account enter the Competition and a dispute thereafter arise regarding the identity of the Entrant, the authorized account holder of said account at the time of entry will be considered the Entrant. “Authorized account holder” is defined as the natural person who is designated an account via the verified email address entered during account registration.
